PROPER USE OF SWAP D.I.Y. (DESIGN-IT-YOURSELF)

myswapmyway.com do not claim any ownership rights in the text, files, images, photos, works of authorship, or any other materials (collectively, “Content”) that you post on or through our SWAP D.I.Y. pages. By displaying or publishing (“posting”) any Content on or through SWAP D.I.Y., you hereby grant to Swap Watches International Inc. a non-exclusive, fully paid and royalty-free, worldwide, limited license to use, modify, delete from, add to, publicly perform, publicly display, reproduce and translate such Content, including without limitation distributing part or all of the service in any media formats through any media channels.

We reserve the right to remove or refuse to post, publish or reproduce images containing content that we determine in our sole discretion are unlawful, offensive, threatening, libellous, false, misleading, defamatory, obscene, pornographic, sexually explicit, abusive, rude, harassing, plagiarized, expresses hate or otherwise objectionable, violates any party’s intellectual property.

- You may not upload any image that is unlawful, offensive, threatening, libellous, false, misleading, defamatory, obscene, pornographic, sexually explicit, abusive, rude, harassing, plagiarized, expresses hate or otherwise objectionable, violates any party’s intellectual property. You may not upload any Content that contains viruses, worms, Trojan horses, time bombs, cancelbots or other similar harmful programming software. You may not upload any information that will be used in any illegal or terrorist activity.

- It is your responsibility to know if your image is copyright-free. You are entirely responsible for any lawsuits brought against you if you choose to use copyrighted images. If in doubt, follow this guideline: If you did not take the photo or create the design, you need permission from the person who created it. If the image you want to use is copyrighted, it is a crime for you to use the photo or image without the written permission of the owner.

- You warrant that you have the permission to use the image of all persons appearing in your Content.

- We have no obligation to monitor, filter, censor, edit or regulate any Content provided by you or third parties on this website, although we reserve the right to do so in our sole discretion. We cannot and do not guarantee that we will post all Content submitted, or that such Content will not be offensive, defamatory or objectionable. Although we reserve the right to remove without notice any Content for any reason, we have no obligation to remove or delete Content that you personally may find objectionable or offensive.

- You represent and warrant that: (i) you own the Content posted by you on or through the myswapmyway.com SWAP D.I.Y. pages or otherwise have the right to grant the license set forth in this section, (ii) the posting and use of your Content on or through the myswapmyway.com SWAP D.I.Y. pages does not violate the privacy rights, publicity rights, copyrights, contract rights, intellectual property rights or any other rights of any person, and (iii) the posting of your Content on or through myswapmyway.com SWAP D.I.Y. does not result in a breach of contract between you and a third party. You agree to pay for all royalties, fees and any other monies owing any person by reason of Content you post on or through the myswapmyway.com SWAP D.I.Y. pages.

- The SWAP D.I.Y. pages contain Content of Users and other SWAP D.I.Y. licensors. Except as provided within this Agreement, you may not copy, modify, translate, publish, broadcast, transmit, distribute, perform, display, or sell any Content appearing on or through the SWAP D.I.Y. pages.

- Your submission of images is voluntary; however, by posting or providing any images, messages, information, text, photos or other Content, you (i) acknowledge and agree that such Content provided by you may be viewed by the general public and will not be treated as private, proprietary or confidential, (ii) irrevocably authorize us and our partners and licensees, without compensation to you or others, to copy, reproduce, modify, distribute, publicly display or otherwise use such Content for any purpose throughout the world in perpetuity in any format, manner or media now known or hereafter devised, and (iii) represent to SWAP D.I.Y. that you own such Content and have the restricted right to permit us to use such Content in the manner stated above without the consent of any third party.

ORDER PROCESS & SHIPPING INFORMATION

All orders placed before 12pm (noon) between Monday to Friday, Pacific Standard time (GMT - 8:00), will be processed on the current day. Order processing will take approximately 2 business days. Orders are expected to be delivered based on the lead time below. Delivery time and shipping cost will vary depending on the location and number of items purchased. North American orders will be delivered by Canada Post, Fedex, UPS, DHL or United States Postal Services.

Please note the following lead times for delivery:

- USA & Canada – 6 - 10 business days

RETURN AND EXCHANGE POLICY

- The customer must include the order acknowledgement and receipt.

- Items to be returned must be in brand new condition, with the original tag price attached.

- Refunds are not allowed, only exchanges are allowed. No money is refunded if a returned item is exchanged for a cheaper item.

- Items that have been altered, damaged, or used cannot be exchanged, unless the item is a factory defect.

- During sale periods, sale items can only be exchanged for other sale items. If the sale period is over, sale items can no longer be exchanged.

- The allowable period for North America returns is 14 days from the date the order was received, including shipping period. For International orders, allowable period is 21 days. The merchandise must be shipped within 24 hours from the date of email notification.

- Shipping and handling cost incurred are non-refundable.

- All responsibilities involved with shipping and handling and costs involved in exchanging / returning and sending back the merchandise will be borne by the customer.

PROCEDURE FOR RETURNING OR EXCHANGING MERCHANDISE

- Notify the company via email (alina@myswapmyway.com) immediately within 24 hours starting from the date of receipt of the merchandise. Specify the reason for exchanging the merchandise and the replacement chosen.

- The company will inform the customer if the merchandise for exchange is available. If available, the company will immediately advise the customer to send back the merchandise to the standard return address within 24 hours of receipt of email notification.

REFUNDS

Refunds cannot be made for returned merchandise. They can only be replaced by merchandise of the same value or lower. 

In the event an item/s ordered is no longer available, customer may opt for a refund in the form of a discount code which they can use within 30 days from the date of issue for their next online purchase, or for monetary refund to their bank account.

DEFECTIVE / DAMAGED MERCHANDISE

Merchandise with factory defect/s must be reported immediately within 24 hours upon receipt of the merchandise.

Merchandise returned that is described as damaged or defective will be tested and inspected. If found defective or damaged, the company will replace the merchandise and pay for the appropriate shipping costs.
